We accidentally started a new tradition last week.? To ensure that I would review the research compiled by the Football Night in America staff for the Sunday and Monday games, I decided to search for one interesting fact per game, to be shared.? With you.

Somali militants flee invasion to avoid losses

MOGADISHU, Somalia (AP) ? The al-Qaida-linked rebels who once controlled nearly all of Somalia's capital and sowed fear throughout the southern part of the country are fleeing their last remaining stronghold because they are outgunned and don't want heavy losses, experts said Sunday.

Kenyan troops invaded the southern Somali city of Kismayo early Friday, and the militant Islamist group al-Shabab announced soon after that their forces were leaving the lucrative port town behind. Kenyan forces have not yet moved through the whole town, but a military spokesman said troops met no resistance on Sunday.

After years of bloody street-by-street warfare, African Union troops from Uganda and Burundi pushed al-Shabab out of Mogadishu in August 2011. The AU troops have since taken over towns outside of Mogadishu as well. Kenyan forces invaded Somalia late last year, and have been moving slowly toward Kismayo.

The once-powerful al-Shabab spent years defending its Mogadishu territory, but since being forced out has chosen to retreat from towns when challenged by African Union forces or Ethiopian troops who moved into western Somalia earlier this year.

"The most plausible explanation is that they fear that they'll be outgunned by the coalition force, and as a result are incentivized to retreat," said Abdihakim Aynte, a Somali political analyst in Mogadishu. "We also know al-Shabab, by nature, couldn't engage in conventional warfare, especially in an urban area."

Aynte noted that al-Shabab fought conventional-style battles with Ethiopian troops in 2006 and 2007 "and the result was bloody and nasty."

Col. Cyrus Oguna, the spokesman for the Kenyan military, said that Kenyan troops now stationed in northern Kismayo are making plans to expand south. Oguna said he didn't know how many al-Shabab fighters are left in Kismayo, but that "we can probably say now that the numbers are less than when we got in."

An al-Shabab spokesman said on Twitter that the militants had left town and residents have reported that government and police buildings once occupied by al-Shabab have been abandoned. Oguna said Kenyan forces are prepared for multiple scenarios.

"If they were going to fight, they were going to be fought. If they were going to run away, there were some contingencies to deal with that," Oguna said.

The conventional wisdom on al-Shabab says they will turn into a guerrilla force that attacks using suicide and roadside bombs. Mohamed Sheik Abdi, another political analyst in Mogadishu, said the group will most likely divide up and attack vulnerable targets.

Yusuf Abdi Hussein, a former colonel in the Somali army, said the future political leadership of Kismayo will also dictate what al-Shabab does. The new administration will either empower or thwart their guerrilla attacks, he said.

"Usually Kismayo is contested by rival clans seeking to manipulate the resources and revenues from the port," Hussein said. "Al-Shabab will take advantages of those clan lines and will side with the disgruntled clans to use them against the government and Kenyan forces. They'll also use that issue to illustrate themselves as the only administration that could keep the two rivals living peacefully together."

Al-Shabab tries to impose an ultra-conservative style of Islam and enforce conservative social rules in areas they control. They carry out public punishments like whippings, stonings and executions.

Robots to keep farmed fish fit and healthy?

The fish we eat for dinner may soon be fit and healthy, not because they spend their lives swimming out in the open ocean, but because a robot of sorts gave them a daily workout in an aquaculture pen.

Fish farms are far from perfect. Some research has shown, for example, that?sea lice from salmon farms are detrimental to migrating wild salmon. And inside the farm, mortality can creep up to around?20 percent due to illness and wounds.?

But as the world?s?wild fish populations continue to plummet?and?human populations continue to increase, aquaculture is likely to play an increasingly important role in feeding the world.

The robotic technology is getting a closer look as one way to improve the industry.

?Exercise in fishes -- as in humans! -- should have a positive effect? on their well-being,?Claudio Rossi?at the Center for Automation and Robotics at the Polytechnical University of Madrid, told NBC News in an email.

Fish that get a daily workout, for example, will have less fat and stronger immune systems as well as be less aggressive.

?Fish would die less because of illness or wounds caused by other fishes, which is an economic advantage,? Rossi said.

He and colleagues contributed a chapter to ?Swimming Physiology of Fish,? a recently published policy book to guide future research on fisheries science and aquaculture.

Their basic idea is to ?devise a system ? that would trigger the natural behavior of schooling, and that could make fish swim in a given way,? Rossi said.

Such a system could be a fish-like robot, such as one under development by Maurizio Porfiri at the Polytechnic Institute of New York University to?steer fish away from pollution and around dams.?

Another possibility is something akin to the?OptoSwim lighting?technology?that stimulates schooling behavior in fish.

Developing the most effective system is a challenge, Rossi noted, given the need for reliability and endurance in a wet environment as well as understanding fish behavior.

?It is not completely clear which are the factors that would ?fool? live fishes and make them behave in a determined way,? he noted.

Refuelling is a very difficult and dangerous procedure when two vessels are at sea, especially if the seas are rough, or there is a storm, or even in the middle of a fire fight. Yet it is also vital as running out of fuel would be devastating to a naval ship in action.

The NRL has designed a system which harvests carbon dioxide and hydrogen, the raw ingredients of jet fuel, from the seawater. NRL discovered that gathering carbon dioxide from the seawater was far more efficient than getting it from the air because the concentration in seawater is 140 times greater. The hydrogen and carbon dioxide go through several processes to create olefins (a hydrocarbon), and then two more steps to turn the olefins into suitable jet fuel. So far the lab tests have indicated that the process will produce jet fuel at a cost of around $3 - $6 per gallon. Now all that is needed is large scale tests on the open sea.

Net Lease Assets Selling Fast

Large realty companies are snapping up entire portfolios made of net leases because of their good returns, lack of operating expenses and tenant base, which consists mainly of corporate renters who pay on credit. The risk is low and the potential for reward is high, and that combination has resulted in two sales within 24 hours with a combined transaction value of more than $3 billion. Experts say these mega-transactions are going to become more common because large investors no longer see the value in acquiring assets piecemeal, opting instead to buy whole portfolios that equal bigger savings, bigger acquisitions and bigger shares of the market. September proved to be a busy month for the single-tenant net lease sector. Within a 24-hour period on Sept. 6, Realty Income Corp., an Escondido, Calif.?based REIT specializing in net lease properties, bought American Realty Capital Trust, which owns 501 mostly net lease buildings, for approximately $2.95 billion; then Lexington Realty Trust, a New York City?based REIT, announced it was acquiring a portfolio of net lease office and industrial properties from its joint venture with Inland American for $480 million.

As Nicholas S. Schorsch, chairman and CEO of American Realty Capital, puts it: ?You?ve got an asset class that?s very durable, with no capital expenditures, long-term leases, corporate credit tenants and no operating expenses. So it makes it particularly appetizing as an investment profile. But more importantly, you?ve got interest rates that are historically low right now, so it?s a very good dynamic?you can get very strong returns, while maintaining honest leverage.?

The mega-transactions taking place indicate that institutional investors? voracious appetites for quality net lease assets have met with a dearth of supply and skyrocketing valuations on one-off deals, says Randy Blankstein, president of the Boulder Group, a Northbrook, Ill.?based real estate services firm focused on the net lease sector.

?Today it?s very difficult to assemble large portfolios and buying whole companies is much easier from that perspective,? Blankstein says. ?You are not really buying the companies per se, you are buying portfolios, and I think you are going to see more of that.?

In fact, when it comes to class-A net lease assets, with credit tenants, long-term leases and locations in the top 50 metropolitan areas, demand has been on par with demand for multifamily properties, currently the hottest investment class in real estate, says Al Pontius, national director of brokerage with Marcus & Millichap Real Estate Investment Services, a Calabasas, Calif.?based brokerage firm. That?s due to several factors, including the perceived safety of the product type and higher return rates compared to other fixed-income investment alternatives, notes Christopher Maling, senior vice president and director of Colliers International?s national retail group.

Today a 10-year government bond would yield a return of approximately 1.5 percent, Maling says, while a net lease building offers returns from 5 percent to 8.5 percent or greater. There is also little risk associated with class-A net lease properties?as long as the location is good and the building is well-maintained there will always be tenants willing to sign leases even if the existing occupant leaves. This inspires greater confidence in conservative investors than the recently volatile stock market.

Plus, net lease properties rarely require intensive management since the majority of them are leased on a triple-net basis, with the landlord bearing no responsibility for the structure.

The challenge for investors has been the fact that there aren?t enough desirable properties on the market to feed existing demand, says Jonathan W. Hipp, president and CEO of Calkain Cos., a Washington, D.C.?based commercial real estate firm specializing in triple-net lease properties. When such properties are available, they are priced at a premium. That?s why most net lease specialists expect to see more company acquisitions like the Realty Income/American Realty deal and more IPOs as stock market investors become more aware of the advantages of net lease REITs.

On Sept. 20, for example, Spirit Realty Capital, a Scottsdale, Ariz.?based company that invests in and manages net lease retail and industrial properties, conducted an IPO valued at approximately $435 million. The firm issued 29 million shares at $15.00 apiece. Spirit Realty owns 1,096 properties in the United States.

?I think interest [in net lease assets] can easily increase,? says Shelby E. L. Pruett, chairman and CEO of Equity Global Management, a Chicago-based principal-oriented investment firm that focuses on single-tenant net lease, sale-leaseback and build-to-suit real estate.

Hard numbers

Net lease retail buildings tend to trade more often than properties in other sectors because they are more accessible to individual investors due to their smaller size (most are valued under $5 million), and there is a greater number of available good-credit tenants in retail than in other commercial real estate sectors. Although the retail sector?s health overall is tied to the economy, retailers that tend to occupy net lease spaces are somewhat protected from recessionary forces, says Maling. A restaurant chain like McDonald?s can drum up healthy sales in a Midwestern suburb and Midtown Manhattan. After all, McDonald?s didn?t earn its top-notch credit rating by opening new stores haphazardly, Maling adds.

This past year, transactions involving net lease retail properties totaled approximately $6.9 billion, with the average cap rate of 6.8 percent and the average price of $254 per sq. ft., according to research by Calkain Cos. Transactions involving office properties totaled $6.6 billion, with the average cap rate of 7.7 percent and price per sq. ft. of $238. Industrial transactions totaled $8.5 billion, with a cap rate of 7.8 percent and an average price of $77 per sq. ft.

Plus, the number of available retail assets nationwide rose 17.88 percent from the first to the second quarter of 2012, to 3,508, according to a Boulder Group report. The number of office properties on the market in the same period fell 9 percent, to 455. The number of available industrial properties rose 20 percent, but the total was only 384 buildings.

The stability of office and industrial properties is more directly tied to job growth than retail assets, so investors tend to feel greater concern about the economic fundamentals of the markets these assets are located in, no matter how long the lease is or how well-respected the tenant. Marcus & Millichap?s Pontius notes a single-tenant bank office headquarters that recently traded in Paso Robles, Calif. The building houses a good-credit tenant, has 10 years remaining on its lease and sold at a cap rate of 8 percent. If the same building, with the same tenant and lease term, went on the market in Los Angeles instead of Paso Robles, it could have easily sold at a cap rate of 6.5 percent, Pontius notes.

?We?ve seen several transactions where, because the office property was in a secondary market and that market was relatively soft, it had an adverse effect on the asset,? says Spencer Levy, executive managing director of capital markets with commercial real estate services firm CBRE.

Plus, since industrial and office deals tend to price in the double digits (from $20 million to $50 million), the pool of potential buyers shrinks significantly, primarily to REITs and private equity funds rather than individual investors.

Average cap rates reflect those differences. In the second quarter, cap rates for net lease properties ranged from an average of 7.5 percent for retail buildings to 8.0 percent for industrial assets to 8.25 percent for office buildings, according to the Boulder Group report.

But because office and industrial buildings now offer better yields than many retail properties, interest in them is increasing. Equity Global initially built its portfolio on retail assets, but now focuses on acquiring both distribution/logistics facilities and single-tenant office buildings, Pruett notes. It is searching for core market properties with leases of 15 years or more and built-in rent escalations of 1.5 percent to 2.5 percent.

Similarly, Paul M. Domb, vice president of asset management with United Trust Fund, a Miami-based firm that specializes in corporate sale-leaseback transactions, notes that cap rates for net lease buildings are currently at historic lows.

?We don?t dictate to the market, the market dictates to us,? says Domb. ?So if we find the right building and we are getting a 7 percent current [cap rate], it?s an acceptable return to us.?

In 2012 United Trust Fund closed approximately 220 million dollars' worth of office and industrial/distribution acquisitions, including West Coast and Midwest corporate headquarters, an Atlantic seaboard regional office and a Carolinas distribution facility. The headquarters acquisitions closed at cap rates in the 7 percent range, says Domb.

In the office sector, buildings occupied by government entities and medical offices are viewed as the safest investments right now, brokers say. FedEx Ground facilities and Amazon.com and Wal-Mart Stores warehouses tend to be the most desirable industrial tenants.

In the second quarter, properties net leased by FedEx traded at a median cap rate of 7.6 percent, according to the Boulder Group. Properties leased to government agencies traded at a median cap rate of 7.79 percent.

Looking ahead

The demand for net lease properties is likely to continue for the foreseeable future. With the Federal Reserve vowing to keep interest rates under 0.25 percent through mid-2015, yields on bonds are not likely to go much higher, says Levy, which means net lease real estate assets should remain a preferred investment type. American Realty Capital?s Schorsch projects that net lease properties will remain in favor for the next three to four years.

With the U.S. economy still on shaky ground, it?s doubtful that a more attractive investment alternative will emerge anytime soon, Scorch and CBRE's Levy say. If aggressive job growth begins, it may lead to investors being able to accept greater risk and abandoning the safety of net lease properties to put money into assets with higher yields. But at the moment that seems less than likely, which is why Walgreens drugstores are among the most popular properties with net lease investors, despite the fact that Walgreens leases last up to 75 years, severely limiting potential for future rent growth.

?Your upside in net lease is capped to a great degree than in a multi-tenant asset,? Levy notes. ?So the good news is you are locked into a long-term lease with a good-credit tenant. And the downside is you are locked into a long-term lease with a good-credit tenant.?

(AP) ? Jason Aldean and Kelly Clarkson are among the first performers announced for this year's Country Music Association Awards.

The two stars, who teamed to win a trophy last year at the ceremony, will be joined by Dierks Bentley and Little Big Town on the broadcast.

Aldean is up for three awards this year, including top honor of entertainer of the year, and Clarkson has been nominated in the female vocalist of the year category, her first solo nomination.

Bentley is up for three CMAs, including album of the year for "Home," while Little Big Town also has three nods.

More performers will be announced later.

Carrie Underwood and Brad Paisley will host the Nov. 1 awards, which will air live on ABC from the Bridgestone Arena in Nashville, Tenn.

Insurer Aviva sells more Italian debt: CFO

LONDON (Reuters) - Aviva , Britain's second-biggest insurer, has sold more of its holdings of distressed Italian government debt in an effort to bolster its balance sheet, it said on Wednesday.

Aviva, in the throes of a restructuring after investors forced out its chief executive in May, "made an additional disposal of Italian sovereign debt during September," the company said in a management presentation published on its website.

The sale comes on top of a 2 billion euro ($2.59 billion)disposal of Italian sovereign debt in June which reduced Aviva's total holding to about 5 billion euros as of July 6, finance chief Pat Regan said at the time.

Aviva, battling to win over investors irked by a weak share price performance, aims to turn itself around by shedding underperforming businesses, cutting costs, and insulating its capital reserves against financial market fluctuations.

The company's regulatory capital buffer fell by a third between July and September last year as the escalating eurozone crisis weighed on the value of bonds issued by heavily indebted governments, stirring fears over its capital strength.

Italian government bonds have fallen steeply in value over the past two years, reflecting worries over the Italy's creditworthiness as its membership of the euro constrains its ability to tackle weak growth and rising debts.

Aviva generated about 40 percent of its operating profit in mainland Europe last year, and holds European sovereign debt partly to generate the income it needs to meet its financial obligations to European policyholders.

Aviva shares were down 2.5 percent by 1100 GMT, underperforming a 2 percent fall in the Stoxx 600 European insurance share index <.sxip>.

Arctic warming could spur regrowth of ancient fossil forest

The paleo-scene won't sprout up overnight, of course, said Alexandre Guertin-Pasquier of the University of Montreal, who will present his research at the Canadian Paleontology Conference in Toronto this week.

A fossilized forest that flourished more than 2.5 million years ago could return to life thanks to a warming planet, scientists say.

The?paleo-scene?won't sprout up overnight, of course, said Alexandre Guertin-Pasquier of the University of Montreal, who will present his research at the Canadian Paleontology Conference in Toronto this week.

Rather, he said, climate forecasts suggest that, by 2100, the now-uninhabited Bylot Island where the?fossilized forest?was discovered will support temperatures similar to those prevalent when the forest thrived.

"The fossil forest found in Bylot Island probably looked like the ones actually found in the [present-day] south of Alaska, where tree-line boreal forest grows near some glacier margins," Guertin-Pasquier wrote in an email. "The main plant diversity also seems to be similar between these two environments," which both include willow, pine and spruce trees. [See Photos of the Fossil Forest Site]

He and his colleagues analyzed samples of wood that had been preserved in the area's peat and permafrost. They specifically looked for pollen, which would reveal the types of trees growing in the area at the time.

To help nail down a specific date when growth occurred, the researchers analyzed the sediments laid down at the time the forest lived. They specifically looked at magnetic particles found in the soil, particularly?magnetite. This works because, throughout our planet's history, the orientation of the magnetic north pole changed several times, a well-documented phenomenon. Since these "magnetic sediments" line up with?Earth's magnetic orientation, scientists can use this to date the sediment layers.

They estimate the forest thrived between 2.6 million and 3 million years ago.

The trees in the ancient forest, as interpreted from the?pollen samples, usually grew in areas with a yearly average temperature of about 32 degrees Fahrenheit (0 degrees Celsius), Guertin-Pasquier said. Currently, average temperatures on Bylot Island hover around 5 degrees F (minus-15 degrees C), he added.

Will our grandchildren actually see this forest come to life?

"I think it's very possible we might see forest compositions of the past returning with warming," Larisa R. G. DeSantis who was not involved in the study told LiveScience. "The question is whether those trees will be able to make it up there," DeSantis said, adding that in some ways it's a lot easier for?animals to migrate?to different conditions.

"But trees have another whole level of difficulty,?their potential for movement?is based on their dispersal of seeds and that sort of thing, so their movement is constrained," said DeSantis, who studies, among other topics, the reconstruction of ancient environments, at Vanderbilt University in Nashville, Tenn.

Fossil forests of a similar age have also been found on Ellesmere Island in the Canadian Arctic, where so-called "mummy trees" were uncovered?in the wake of a melting glacier. The spindly, mummified trees showed signs of stress, likely the result of a changing climate (from a greenhouse to an icehouse, of sorts) as well as the seasonal darkness occurring at the top of the world.

That, in fact, is one of the mysteries surrounding these Arctic forests, "how these trees managed to survive the relentless dark of the Arctic winter," Guertin-Pasquier said.

Next, the researchers plan to look more closely at other plant remains from Bylot Island to get a better idea of the possibly diverse flora.

Budget Law Will Freeze Sport Fish Restoration Fund | Bass Fishing ...

On September 14, the Office of Management and Budget (OMB) released its recommendations for budget cuts that include withholding parts of the Sport Fish Restoration and Boating Trust Fund, a move that would have a significant effect on fisheries conservation and the jobs it supports. OMB?s action was triggered by the failure of the Congress and the Administration to enact a plan to reduce the deficit by $1.2 trillion, as required by the Budget Control Act of 2011.

?The angling and boating community was shocked to learn that for the first time in its 62-year history, the Sport Fish Restoration and Boating Trust Fund ? the backbone of fisheries conservation in the United States ? is recommended for a cut under sequestration totaling $34 million,? said Gordon Robertson, vice president of the American Sportfishing Association.

Robertson further said, ?This conservation trust fund, established in 1950 with the support of industry, anglers and state conservation agencies, is an outstanding example of what good government should be and is the backbone of the user-pay model of funding conservation in this nation. It is important that it remain untouched. The sportfishing and boating communities are ready to work with Congress and the Administration to solve this problem.?

The Sport Fish Restoration Act of 1950 placed a federal excise tax on all recreational fishing equipment, which manufacturers pay and is then incorporated into the cost of the equipment that anglers purchase. In 1984 the Act was amended to include that part of the federal gasoline fuel tax attributable to motor boat use. The total annual value of the Trust Fund is approximately $650 million. The monies from the fund are apportioned to state conservation agencies for sport fish restoration, boating safety, angler and boater access and other fishing and boating programs.

?When anglers and boaters pay the equipment tax or the fuel tax they are doing so with the understanding that this money is going to a trust fund dedicated ? by law ? to the resources they enjoy,? said Robertson. ?Withholding funds from this essential program at a time when state fishery programs are already struggling to ensure the best quality service to anglers and resource management will only cause fishery resources to suffer even more and cause job losses associated with the loss of recreation fishing boating programs. The sportfishing and boating industries as well as anglers and boaters themselves fail to understand how cutting a user-pay trust fund helps the economy.?

Recreational fishing contributes $125 billion each year to the nation?s economy and supports more than one million jobs. Since its inception, the Sport Fish Restoration Act has pumped $7 billion into habitat restoration, access and boating safety programs.

The Sport Fish Restoration and Boating Trust Fund?s older sibling, the Wildlife Restoration Act of 1936, after which the Sportfish Trust Fund was patterned, is slated for a $31 million freeze. That Act is funded by hunters and men and women who engage in the shooting sports and archery, who pay a similar tax to support wildlife restoration. ?This level of cuts to conservation programs that pay their own way is unprecedented and all anglers, hunters and shooting sports enthusiasts must speak up to prevent these cuts,? Robertson concluded.

Along with these two cornerstone conservation acts, many other critical conservation funds are also listed for significant cuts. Congress, with the cooperation of the Administration, must address the sequestration schedule and they will not occur until after the elections and possibly not until early 2013 and with a new Congress.

?We encourage all anglers to go to www.KeepAmericaFishing.org for information about when Congress may act and when anglers should speak up to maintain critical conservation funding,? Robertson said.

Primate study adds to evidence of BPA harming human reproduction

A Washington State University researcher has found new evidence that the plastic additive BPA can disrupt women's reproductive systems, causing chromosome damage, miscarriages and birth defects.

Writing in the journal Proceedings of the National Academy of Sciences, WSU geneticist Patricia Hunt and colleagues at WSU and the University of California, Davis, report seeing reproductive abnormalities in rhesus monkeys with BPA levels similar to those of humans. By using an animal with the most human-like reproductive system, the research bolsters earlier work by Hunt and others documenting widespread reproductive effects in rodents.

"The concern is exposure to this chemical that we're all exposed to could increase the risk of miscarriages and the risk of babies born with birth defects like Down Syndrome," says Hunt. "The really stunning thing about the effect is we're dosing grandma, it's crossing the placenta and hitting her developing fetus, and if that fetus is a female, it's changing the likelihood that that female is going to ovulate normal eggs. It's a three-for-one hit."

The research also adds to the number of organs affected by BPA, or bisphenol A, which is found in plastic bottles, the linings of aluminum cans and heat-activated cash register receipts. This May, Hunt was part of another paper in PNASreporting that the additive altered mammary development in the primate, increasing the risk of cancer.

Hunt's colleagues at UC, Davis exposed different groups of gestating monkeys to single daily doses of BPA and low-level continuous doses and looked at how they affected the reproductive systems of female fetuses. She saw that in the earliest stage of the adult's egg development, the egg cell failed to divide properly. Earlier mouse studies showed similar disturbances translated into genetic defects in the mature egg.

A fertilized egg with the wrong number of chromosomes will almost always fail to come to term, leading to a spontaneous abortion or progeny with birth defects.

In monkeys exposed continuously, Hunt saw further complications in the third trimester as fetal eggs were not packaged appropriately in follicles, structures in which they develop. Eggs need to be packaged properly to grow, develop and mature.

"That's not good," says Hunt, "because it looks to us like you're just throwing away a huge number of the eggs that a female would have. It raises concerns about whether or not she's going to have a really short reproductive lifespan."

When veteran legislative staffer Howard Posner began working on a bill that would allow driverless, computer-controlled cars to roam California?s highways, he figured lawmakers would find the idea alarming.

They didn?t.

?Eventually, you might be on the freeway, and someone might not be behind the wheel,? said Posner, a consultant to the Assembly Transportation Committee, in an unusual moment of candor for a legislative staff member. ?By the time this thing rolls out, people will probably be more comfortable. But today they?re not, and I assumed the legislators would have the same feeling.?

The legislation pushed by Google, which makes the autonomous car technology, passed 37-0 in the Senate and 74-2 in the Assembly. It is now awaiting action by Gov. Jerry Brown.

In voting for the legislation, lawmakers on both sides of the aisle said they believed the technology would make the roads safer and keep California at the forefront of innovation.

The easy passage of the bill, which was sponsored by state Sen. Alex Padilla, D-Van Nuys, also showed the growing clout of the Mountain View company, said Rob Stutzman, who was deputy chief of staff to former Gov. Arnold Schwarzenegger.

?It was a powerful effort that they put together,? said Stutzman, who represents carmakers that opposed the bill. ?They picked a powerful author. They clearly lobbied the governor?s administration as well.?

Disclosure statements filed by Google show that the company repeatedly lobbied the Legislature, the California Highway Patrol and the Department of Motor Vehicles from October to July on the issue. During that period, Google paid $140,000 for the lobbying services of Jonathan Ross, from the prominent Sacramento firm KP Public Affairs.

During the 2009-10 legislative session, Google gave campaign contributions totaling $64,000 to 36 members and successful candidates for the state Senate and Assembly. It also gave $25,900 each to Brown and his unsuccessful Republican rival, Meg Whitman. The company has not reported making any campaign contributions during the current election cycle.

Padilla?s bill, SB 1298, would allow companies to test self-driven cars on public roads and require the DMV to draft rules governing use of the vehicles by the public. The measure also would define?a car?s ?operator? as the person sitting in the driver?s seat, or if there?s no one in the driver?s seat, the person who ?causes the autonomous technology to engage.?

A similar law won approval in Nevada last year, and Google is lobbying other states to follow suit. The company reported spending $8.95 million during the first half of 2012 to lobby federal officials on numerous issues, including the driverless car.

Padilla, who has a mechanical engineering degree from MIT, promoted the legislation in March at a press conference on the front steps of the state Capitol after arriving in a Google car.

?The vast majority of traffic fatalities and injuries are caused by human error," Padilla said at the time. "Can we utilize and incorporate state-of-the-art technology to make our vehicles and?therefore our roads and society safer?"

Currently, California has no prohibition against operating the so-called autonomous cars on public roads. The car uses video cameras, radar and lasers to drive in traffic and GPS to navigate. Google has driven its cars 300,000 miles without an accident while in self-driving mode, a Google spokesman said.

?We believe that the vehicle code should be updated explicitly to permit the testing and operation of autonomous vehicles in accordance with specific safety requirements, to ensure that any use of autonomous vehicles on California roads is conducted in a safe manner,? said Google spokesman Jay Nancarrow in an email.

California lawmakers gushed over the new technology as they cast their votes for the bill.

?It?s just a really cool thing that we?re going to have autonomous vehicles in California,? Assemblyman Bob Blumenfield, D-San Fernando Valley, said on the Assembly floor last month.

Working out the details of the bill, however, was not so simple.

Automakers were worried about their liability in the event that the computer driving a car malfunctioned. Privacy advocates worried about how Google would use the vast amount of travel data it would collect on each car. Some legislators initially wanted Google to come back for separate legislation to authorize driverless operation after more testing was done. The California Highway Patrol and DMV were uncertain about the new technology.

?Behind the scenes it was a real struggle,? said Posner, the committee consultant.

By the time the bill reached the Assembly Transportation Committee in late June, the Highway Patrol?s concerns, including who would write the rules of the road for self-driving cars, had been resolved, Padilla told the committee. But representatives for the California Highway Patrol, who would normally attend such a hearing, were not in the room at the time, Posner said.

Their conspicuous absence sent a message to everyone: ?They've been silenced by the governor's office,? Posner said.

A spokeswoman for the California Highway Patrol declined to comment. A spokesman for the governor?s office didn?t return an email seeking comment. Padilla declined a request for an interview.

In its final form, the bill would give the DMV authority to reject the use of driverless cars that did not meet its standards. The measure also would require that owners be notified about what data their car is collecting, but it did not resolve questions of liability.

?Google, and I don't mean this negatively, they wanted everything now,? said Posner. ?They didn't want to have to come back for subsequent legislation.?

Posner said he will soon retire after 40 years working for the state, and so he doesn?t mind being candid about the maneuvering behind the Google legislation.

?The benefits of this could be enormous,? he said, ?but if you don't do this right, there could be some horrific accidents.?

(AP) ? The hills of Custer State Park are set to rumble as the hooves of about 1,300 buffalo thunder across the prairieland during the 47th annual Buffalo Roundup.

Thousands of spectators began to stream into the park shortly after 6 a.m. Monday to get a firsthand look at the animals as they stampede down the prairie. A pancake breakfast, hot chocolate and coffee are on offer to keep the visitors warm.

Cowboys and cowgirls are herding the buffalo into corrals at the park, where entrance is free for the day.

About 300 buffalo will be up for auction Nov. 17. The buffalo are bought to supplement or start herds, or to be eaten.

Among the programs offered by TROY's new Montgomery Confucius Institute office will be ?Chinese in Schools,? aimed at developing Chinese language programs in Alabama schools.

?Knowledge of Chinese language and culture is becoming increasingly important for Alabama and America,? said Dr. Iris Hong Xu, director of the Confucius Institute at Troy University. ?The new Montgomery office will offer an extensive support program for teachers and students of Chinese language and culture in local schools.?

The ?Chinese in Schools? program will provide training and professional development for teachers, networking for schools taking part in Chinese language initiatives and after-school programs for middle and high school students, among other services.

For local businesses, the Confucius Institute offers a variety of programs and services aimed at promoting economic development, tourism and exchange between the U.S. and China. The Institute can provide on-demand translation services for businesses, organize language and cultural training for business groups headed to China and act as a service provider for businesses currently operating in China or planning to do so.

UPTOWNflavor ? Review: Harlem BarBQ

If you visit Harlem today, compared to say 5 years ago, even a neighborhood local can?t deny that the atmosphere and demographic has changed. New restaurants are migrating uptown to call Harlem their new home, bringing along with them a new and more food focused attitude. Now, you can walk down various select blocks and hand-pick where you want to meet friends for happy hour, where you will have an amazing dinner, and where you and your girls will eat brunch over the weekend.

In Harlem it?s vital to keep up with the times and be flexible to all that is new and developing around you. Harlem BarBQ on the corner of 127th and Frederick Douglass Blvd came to the neighborhood a few years ago, just as Harlem was developing on the restaurant scene. ?At first, people were skeptical of this restaurant, especially because the name was so closely associated to another highly popular restaurant in NYC. I thought the same way too until I had the pleasure of meeting Alex Ortiz, Harlem BarBQ?s public relations manager and graphic designer. I went to Harlem BarBQ with a completely open mind recalling what Alex said about the changes going on in the restaurant. Alex stated:

?We want to reach out to all of?Harlem?and Uptown to introduce everyone to a new place to meet, eat and drink. With special?privileges? of becoming a VIP member with many rewards and discounts, this will provide a better way of ?saving money for them and keeping our ongoing customers to return to the restaurant. Harlem is going through some major changes. I?believe?we will be better than downtown? uptown will be the new downtown with broad range of?different?ethic cultures and better clubs, bars and?restaurants.?

As Alex explained, there are plenty of new things being implemented at Harlem BarBQ. A new happy hour which includes their very popular 20 oz frozen drinks for $5.99 and also a new membership program that offers special deals to membership card holders. Also coming soon is a downstairs area with a bar for after hours drinks and snacks and can also be booked for private parties. ?On to the good stuff, the food and drinks! Once I got the memo that Harlem BarBQ is NOT and in no way associated with Dallas BBQ, my friends and I were ready to go over the menu and see what is being offered. To start I was promptly greeted at my table by a friendly waitress and a basket of warm and soft cornbread. ?I ordered a frozen mango patron margarita, amongst the variety of frozen and non- frozen beverages which also consisted of beer on tap; wines by the glass, and also sangria by the glass or the pitcher.

Waiting for our drinks to arrive from the bar we looked over the menu. Every aspect of what someone would want out a menu is covered. Appetizers, salads, and main entrees along with sides and desserts. We wanted to try so many things, but we opted for several appetizers that included buffalo mac -n- cheese; pulled pork sliders; catfish bites with chipotle dipping sauce, and for dessert we ordered a warm apple crumble with vanilla ice cream which was recommended to us by the owner. Impressively, the food was delicious. Everything was fresh and prepared perfectly. I have never had buffalo chicken mac-n-cheese, but after tasting Harlem BarBQ?s version, I was the main one at the table eating it because it was so good!

Alex informed us that all of the food is made from scratch daily. The fries are hand-cut every single day and they even make their own Hennessy caramel that goes into the popular Caramel Hennessy coladas. I was highly impressed with what?s going on inside of Harlem BarBQ. Alex , the owner and the entire staff are putting great strides forward to adapt and change to the incoming neighborhood around them without losing the essence of the restaurant that they started out with. With these new and improved adaptations it can only get better from here.
