Owning a piece of land in Delhi is a lifetime dream for many. Plot indeed makes a sought-after option, whether you want to build a house for yourself or reap rich returns on investment. At the same time, buying a plot involves a certain element of risk. Most of the disputes on property transactions arise due to ownership rights. Especially in a city like Delhi, you have to be extremely cautious before entering into any land transaction.
With a view to provide a quick snapshot of what all you should consider before buying a plot in Delhi, MagicBricks.com spoke to various real estate and legal experts. While it is clear that property registration document is the primary and most reliable source for checking authenticity of ownership, you may still find a number of owners who inherited the land and do not have property registration certificates with them. At the same time, possibilities of fake registration documents cannot be ruled out.
?Land is a complex matter in Delhi. A large number of land deals in Old Delhi take place on the basis of agreement of sale done on stamp papers of Rs 100 or so,? says Umesh Sharma, Partner, Flyfot Group of Advocates, adding, ?Such transactions run a high degree of risk as the seller may not be the legal owner of the property. In fact, the Supreme Court has ruled that transactions carried out in this manner are invalid?.
So, how should you authenticate the ownership? Along with property registration documents, house tax receipts from the Municipal Corporation of Delhi (MCD) shall be checked for the purpose. In order to undertake a proper due diligence process, house tax department can be approached. ?House tax department has records with respect to ownership as well as transfer of ownership,? says Ravindra Sharma, a legal expert.
Besides title deed and revenue records, water and electricity connection related documents issued by the government departments shall also be scrutinized before the transaction. ?In order to avoid any disputes pertaining to multiple ownerships, a buyer has an option to ask the owner to issue a public notice,? Sharma told.
